RE: The tariff classification of Tazarotene (CAS-118292-40-3) in bulk form, from Finland

Dear Ms. Addabbo: In your letter dated April 27, 2011, you requested a tariff classification ruling.

The subject product, Tazarotene, is a member of the acetylenic class of retinoids. It is indicated for the topical treatment of patients with stable plaque psoriasis of up to 20% body surface area involvement. It is also indicated for the treatment of facial acne vulgaris of mild to moderate severity.

The applicable subheading for the Tazarotene in bulk form will be 2934.99.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Nucleic acids and their salts, whether or not chemically defined; other heterocyclic compounds: Other: Other: Aromatic or modified aromatic: Other: Drugs.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
